Terms and Conditions of Service
These Terms and Conditions (“General Terms and Conditions of Service”) apply to any service provided by Maple Leaf Appliance Repair to you, the Customer. By requesting and allowing our appliance repair technicians to commence work on your appliances, you agree to the terms detailed herein. These terms define the service relationship, the scope of our responsibilities, and your responsibilities as a service customer. If you have questions or concerns, we encourage you to contact our customer support team for clarification before work begins.
1. Non-Refundable Service Charge
Maple Leaf Appliance Repair charges a non-refundable service fee (“Service Charge”) for every diagnostic visit. This Service Charge will be disclosed to customers at the time of scheduling and covers the costs associated with travel, diagnostic services, and initial assessments conducted by our professional appliance repair team. By confirming the Service Contract, you acknowledge that:
- The Service Charge is payable in full, regardless of whether you proceed with the recommended repairs.
- If you decide to authorize the repair after diagnosis, the Service Charge will be applied toward the total cost of the repair.
- Any additional services beyond the diagnostic work may incur additional service charges, which will be disclosed to you prior to commencement of work.
2. Payment Terms and Collection Policy
Payment for services, including all service charges and any additional fees, is due upon completion of the repair unless otherwise agreed in writing. Payment methods include cash, check, and major credit cards. Furthermore:
- If it becomes necessary to pursue legal actions to collect unpaid amounts, you will be liable for all expenses incurred by Maple Leaf Appliance Repair, including reasonable attorney’s fees, filing fees, and related costs.
- Failure to remit payment promptly may result in suspension of future services.
3. Limited Warranty on Parts and Services
Maple Leaf Appliance Repair offers a limited warranty on parts and labor. We warrant that all repairs, replacement parts, and services provided will be free from defects in materials and workmanship for a period of ninety (90) days from the date of repair. Under this limited warranty:
- Maple Leaf Appliance Repair will, at its discretion, replace any defective parts or repair any defect in workmanship at no additional charge within the warranty period.
- This warranty is limited to the repair warranty period and does not apply to any future appliance issues that may arise outside of the specified 90-day coverage.
- Warranty claims must be submitted in writing and are subject to approval by Maple Leaf Appliance Repair.
4. Exclusions from Warranty
Certain exclusions apply to the limited warranty:
- Commercial Use: Repairs on appliances used in commercial or industrial settings are not covered.
- Cosmetic or Non-Functional Parts: Parts that do not affect appliance performance, such as decorative elements, trims, knobs, and counter tops, are excluded.
- Relocated Appliances: Appliances moved from their original location post-repair are not covered under this warranty.
- Refrigeration Equipment: Due to the complexity of refrigeration equipment, this warranty excludes any incidental damages or consequential damages arising from refrigeration component failures, including food spoilage.
- Complex Components: Certain high-risk repairs, such as glass cooktops, carry an inherent risk of breakage and are not covered under warranty.
5. Limitation of Liability
TO THE EXTENT PERMISSIBLE BY LAW, MAPLE LEAF APPLIANCE REPAIR DISCLAIMS LIABILITY FOR ANY INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS ARISING FROM SERVICE FAILURE OR DELAY. In cases of identifiable carelessness by our appliance repair technicians, liability for damages is limited solely to the amount paid for the services performed. This limitation of liability excludes:
- Personal Injury: We assume no liability for injuries sustained from appliance misuse or other factors beyond our control.
- Property Damage: Damages to flooring, cabinetry, or countertops due to appliance movement are not covered.
6. Customer Responsibilities and Waivers
As part of our agreement, customers are expected to acknowledge and accept the following Damage Waivers. These waivers apply to specific repair scenarios and transfer certain responsibilities to the customer, allowing Maple Leaf Appliance Repair to offer affordable services.
- Waiver of Damages for Moving Appliances
Certain repairs require our technicians to move heavy appliances, creating a potential risk of damage to the machine and surrounding areas. By allowing our technicians to move appliances, the customer assumes all associated risks, including but not limited to damages to countertops, cabinetry, and flooring. - Water Supply and Leakage Waiver
Repairs on appliances connected to the home’s water supply, such as washing machines and dishwashers, involve the risk of unintended leakage. By authorizing these repairs, you waive liability for any water damage or flooding resulting from these repairs, unless directly caused by identifiable negligence by the technician. - Refrigeration Equipment Damage Waiver
Refrigeration equipment consists of complex components that are susceptible to unforeseen failures. Customers acknowledge that repairs may not guarantee full restoration and assume the risk of food spoilage in the event of malfunction. - Glass Cooktop Breakage Waiver
Repairs requiring the lifting of glass or ceramic cooktops carry a high risk of breakage due to strong adhesives and fragile materials. By authorizing such repairs, you agree to assume responsibility for any damage resulting from the lifting of these components.
7. Service Call Cancellation Policy
Maple Leaf Appliance Repair requires 24-hour advance notice for any cancellation. Cancellations made within this period may incur a cancellation fee. If you need to reschedule, our customer support team will work with you to find a convenient time. Multiple late cancellations or missed appointments may result in the loss of priority scheduling privileges.
8. Entire Agreement
These Terms and Conditions, along with any Service Order, constitute the entire agreement between Maple Leaf Appliance Repair and the Customer. Any prior agreements, verbal or written, are superseded. No additional terms or representations made by either party will modify this agreement unless documented in writing and signed by both parties.
9. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the state of Texas. Any disputes arising under this Agreement will be resolved by a competent jurisdiction in Texas, with exclusive personal jurisdiction over both parties. Where arbitration is necessary, it will follow the guidelines of the Federal Arbitration Act and the Commercial Rules of the American Arbitration Association.
10. Privacy and Data Protection
Maple Leaf Appliance Repair is committed to protecting your privacy and only collects information necessary for service purposes. We encourage customers to review our Privacy Policy for details on data handling and protection.
11. Additional Terms and Intellectual Property
- Intellectual Property Rights
All content materials on our website and service documentation are the intellectual property of Maple Leaf Appliance Repair. You are granted limited usage rights solely for personal, non-commercial use. Unauthorized access, reproduction, or distribution of proprietary rights and content materials is prohibited. - Third-Party Content and Links
Our website may feature third-party content or links to third-party websites. Maple Leaf Appliance Repair is not liable for any content or privacy practices on third-party sites. By hiring our services, you acknowledge that only parts meeting industry standards will be used, unless otherwise agreed upon in writing. We take security seriously and employ measures to protect your data from unauthorized access. However, Maple Leaf Appliance Repair disclaims responsibility for any security breaches resulting from third-party actions or unauthorized access.
12. Limitations of Liability
MAPLE LEAF APPLIANCE REPAIR LIMITS LIABILITY FOR DAMAGES TO DIRECT DAMAGES ONLY, TO THE EXTENT PERMISSIBLE BY LAW. WE ARE NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGES FOR LOSS OF USE, INTERRUPTION OF SERVICE, OR DAMAGE TO OTHER PROPERTY OR APPLIANCES. This limitation applies to all legal claims, including breach of contract, warranty claims, or tort claims.
13. Scheduling of Service and Customer Satisfaction
Our goal is to provide reliable, timely, and uninterrupted access to professional appliance repair services. However, circumstances may require changes in scheduled service times due to unforeseen conditions. Maple Leaf Appliance Repair reserves the right to modify appointments with as much notice as possible. Customer satisfaction is of utmost importance to us, and our customer support team will assist you with rescheduling in case of any disruptions to maintain a high level of service.
14. Additional Services and Amendments to Terms
Maple Leaf Appliance Repair may introduce additional services or amend these terms from time to time. We will notify customers of any significant changes, and continued use of our services constitutes acceptance of updated terms. We encourage customers to review these terms periodically.
